Nevada Injured Employee Workers Compensation Benefits

- Nevada Workers Compensation Medical Benefits -
- Medical benefits for injured Nevada workers are paid without length of time or cost limitations.

- Who Chooses the Physician for Injured Workers in Nevada -
- Injured Nevada workers must go to an authorized medical provider. Insurers may use a managed care organization (MCO), preferred provider organization (PPO), health maintenance organization (HMO) or the insurance company’s internal managed care unit.

- Nevada Workers Compensation Disability Benefits -
- Temporary Total Disability (TTD) Benefits:
- Compensation is 66 2/3 percent of the injured Nevada workers wage.
- No minimum weekly payment.
- Maximum weekly payment is 100 percent of the Nevada maximum average weekly wage which is $784.35.
- Maximum number of payments is the length of the disability.
- Note:
- Current Nevada published maximum average weekly wage is: $784.35.
- Permanent Total Disability (PTD) Benefits:
- Compensation is 66 2/3 percent of the injured Nevada workers wage.
- No minimum weekly payment.
- Maximum weekly payment is 100 percent of the Nevada maximum average weekly wage which is $784.35.
- Maximum number of payments is life.
- Permanent Partial Disability (PPD) Benefits:
- Compensation percent of the injured Nevada workers wage is not specified.
- For scheduled injuries the maximum weekly payment is 100 percent of the Nevada maximum average weekly wage which is $784.35.
- For scheduled injuries the minimum is payable but not set out in statute.
- Non-scheduled injuries the maximum period of payments is the length of disability and the maximum amount payable is not limited.
- The disability rating is determined by a commission.

- Nevada Workers Death/Dependency Benefits -
- Upon work related death of a Nevada worker benefits are paid to the surviving dependents as prescribed by Nevada law.

- Nevada Workers Compensation Attorney Fees -
- Nevada Revised Statutes 616A.435-465 empowers the Nevada Attorney For Injured Workers to represent without fee, a claimant before the appeals officer, the administrator, district court, or supreme court. Upon request by an injured worker, NAIW may be appointed by an Appeals Officer or the Administrator of the Division of Industrial Relations.
